These Terms and Conditions ("Terms") govern your use of the Crimson Trails Canada website and your booking of wilderness tours and expeditions operated by Crimson Trails Canada, located at 218 Bear Street, Banff, AB T1L 1B7 (BN: 789124563 RC0001). By booking a tour or using our website, you agree to these Terms.
Acceptance of Terms
By accessing crimsoncoffee.one, submitting a booking enquiry, or confirming a tour reservation, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services. These Terms apply to all travellers on a booking, and the person making the booking confirms they have authority to accept on behalf of all participants.
Booking, Deposits & Pricing
All tour prices are quoted in Canadian dollars (CAD) per person unless otherwise stated. Applicable GST and tourism levies are additional where required. Prices are subject to change without notice until a booking is confirmed with a deposit. A non-refundable deposit of thirty percent (30%) of the total tour price is required to confirm your reservation. Final payment is due sixty (60) days before departure. Bookings made within sixty days of departure require full payment at time of booking. We accept major credit cards and e-transfer for Canadian residents. Failure to pay the balance by the due date may result in cancellation and forfeiture of your deposit.
Group Sizes & Trip Modifications
Crimson Trails Canada operates with a maximum of eight travellers per departure unless otherwise specified. We reserve the right to modify itineraries due to weather, trail closures, wildlife activity, or safety concerns. Guides have final authority on all route decisions in the field. If we cancel a departure due to insufficient enrolment, you will receive a full refund or the option to transfer to another date. Minimum enrolment numbers vary by tour and are communicated at booking.
Cancellations, Refunds & Travel Insurance
Cancellation by the traveller is subject to the following schedule: more than ninety (90) days before departure — deposit forfeited; sixty to ninety (90) days — fifty percent (50%) of total price; less than sixty (60) days — one hundred percent (100%) of total price. We strongly recommend comprehensive travel insurance covering trip cancellation, medical evacuation, and adventure activities. Crimson Trails Canada is not responsible for costs arising from traveller cancellation, missed flights, or failure to obtain adequate insurance. Refunds are processed within fourteen (14) business days to the original payment method.
Assumption of Risk & Waivers
Wilderness travel involves inherent risks including but not limited to adverse weather, difficult terrain, wildlife encounters, remote locations with limited medical access, and physical exertion. By participating in a Crimson Trails tour, you acknowledge these risks and agree to complete our liability waiver and medical disclosure form before departure. You confirm that you are physically capable of completing the described itinerary and that you will follow guide instructions at all times. Minors must have a parent or legal guardian sign all waivers.
Intellectual Property
All content on the Crimson Trails Canada website — including text, photographs, logos, itineraries, and field guide materials — is the property of Crimson Trails Canada or its licensors and is protected by Canadian copyright law. You may not reproduce, distribute, or commercially exploit any content without written permission. Photographs taken by guides during tours may be used by Crimson Trails for marketing purposes unless you opt out in writing before departure.
Limitation of Liability
To the maximum extent permitted by Alberta law, Crimson Trails Canada's total liability for any claim arising from a tour shall not exceed the amount paid by the traveller for that specific booking. We are not liable for indirect, consequential, or punitive damages, loss of personal property, flight delays, or events beyond our reasonable control including natural disasters and government travel restrictions. Nothing in these Terms excludes liability for death or personal injury caused by our proven negligence.
Traveller Responsibilities & Conduct
Travellers are responsible for arriving at the designated meeting point on time with appropriate gear as specified in pre-departure materials. You must disclose all relevant medical conditions, dietary requirements, and fitness limitations at booking. Disruptive behaviour, intoxication, or refusal to follow guide safety instructions may result in removal from a tour without refund. You are responsible for valid travel documents including passports and visas where required. Respect for Indigenous territories, local communities, wildlife, and Leave No Trace principles is mandatory on all departures.
Governing Law & Jurisdiction
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising from these Terms or a tour booking shall be subject to the exclusive jurisdiction of the courts of Alberta. If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
